Terms of Use

1. Acceptance and provider

These Terms of Use govern your use of the Boreki iPhone app and the Boreki website, including Web Studio. The services are provided by Borealbit Technology Limited. By downloading, accessing, or using them, you agree to these Terms.

Your App Store license is also subject to Apple's Standard Licensed Application End User License Agreement. These Terms supplement that agreement; mandatory platform terms and applicable law control if there is a conflict.

2. License and permitted use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Boreki on devices you own or control for lawful personal or professional creative work. The app is licensed, not sold. You may not copy, resell, sublicense, reverse engineer, interfere with, or bypass security or purchase controls except where applicable law expressly permits it.

3. Lighting estimates and production decisions

Boreki uses the iPhone camera to estimate reflected light, including relative brightness, color temperature, and tint. Results can change with surface color, mixed light sources, lens choice, exposure, device, and environment. They are creative references and are not incident-light, spectral, safety, electrical, medical, or professionally calibrated measurements.

You are responsible for checking results and for all production decisions, including equipment placement, rigging, electrical load, heat, accessibility, and on-set safety. Do not rely on Boreki where inaccurate information could cause injury, property damage, or other serious harm.

4. Your content and local storage

You retain rights in the projects, notes, measurements, photos, and recipes you create. You confirm that you have the rights and permissions needed to use that content. The iPhone app and Web Studio are local-first and do not provide cloud backup or cross-device sync. You are responsible for exporting or backing up important work. Deleting app or browser data may permanently remove it.

5. Boreki Pro purchase

Boreki Pro is offered as a one-time, non-consumable in-app purchase rather than a subscription. The App Store shows the price and currency applicable to your storefront before purchase. Apple processes payment, restoration, taxes, and refunds under its terms. If eligible, refund requests are made through Apple's Report a Problem service.

Features, compatibility, and availability may change as the product evolves. A purchase does not include future products or services that are clearly offered separately.

6. Website and Web Studio

Web Studio is a browser-based companion tool. It stores recipes in the current browser and may behave differently from the iPhone app. It does not promise an account, cloud sync, smart-light control, or permanent storage. You must not misuse the website, probe or disrupt its security, automate abusive traffic, upload malicious material, or violate another person's rights.

7. Third-party services

Boreki relies on services such as Apple's App Store and StoreKit, Cloudflare website delivery, and links to third-party sites. Those services are governed by their own terms. We are not responsible for third-party services outside our control.

8. Our rights

Boreki, its software, design, branding, and site content are owned by Borealbit Technology Limited or its licensors and are protected by applicable intellectual-property laws. Except for the limited license above, no rights are transferred to you. Feedback you voluntarily provide may be used to improve the product without obligation to you.

9. Availability, changes, and termination

We may fix, update, change, suspend, or discontinue parts of the services. We do not guarantee uninterrupted availability or compatibility with every device, browser, accessory, or future operating-system version. You may stop using the services at any time. We may suspend access where reasonably necessary to address unlawful use, abuse, security risk, or a material breach of these Terms.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the services are provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, non-infringement, or uninterrupted operation. To the maximum extent permitted by law, Borealbit Technology Limited and its personnel will not be liable for indirect, incidental, special, consequential, or punitive losses, or for lost content, revenue, opportunity, or production time arising from use of the services.

Nothing in these Terms excludes rights or liability that cannot lawfully be excluded or limited.

11. Changes and contact

We may update these Terms to reflect product, provider, or legal changes. The date above identifies the latest version. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

在遵守本条款的前提下，我们授予你有限的、个人的、非独占、不可转让且可撤销的许可，以便在你拥有或控制的设备上，将 Boreki 用于合法的个人或专业创作。App 以许可方式提供，并非出售。除适用法律明确允许外，你不得复制、转售、再许可、反向工程、干扰服务，或绕过安全与购买控制。

3. 灯光估算与制作决策

Boreki 使用 iPhone 相机估算反射光，包括相对亮度、色温和色偏。表面颜色、混合光源、镜头选择、曝光、设备和环境均会影响结果。这些结果仅供创作参考，并非入射式、光谱式、安全、电气、医疗或专业校准测量。

你须自行核验结果，并对所有制作决策负责，包括设备摆放、吊装、电气负载、热量、无障碍和现场安全。当不准确信息可能造成人身伤害、财产损失或其他严重后果时，请勿依赖 Boreki。

4. 你的内容与本地存储

你保留对自己创建的项目、备注、测量、照片和配方的权利，并确认拥有使用这些内容所需的权利与许可。iPhone App 和 Web 工作台均采用本地优先设计，不提供云备份或跨设备同步。你有责任导出或备份重要内容；删除 App 或浏览器数据可能导致内容永久丢失。

5. Boreki Pro 购买

Boreki Pro 是一次性非消耗型 App 内购买，并非订阅。购买前，App Store 会显示适用于你所在商店的价格和币种。付款、恢复购买、税费和退款均由 Apple 按其条款处理；符合条件的退款请求可通过 Apple“报告问题”服务提交。

随着产品演进，功能、兼容性和可用性可能发生变化。该购买不包含未来明确单独提供的产品或服务。

6. 网站与 Web 工作台

Web 工作台是浏览器端配套工具，在当前浏览器内保存配方，其行为可能与 iPhone App 不同。它不承诺提供账号、云同步、智能灯控制或永久存储。你不得滥用网站、探测或破坏其安全机制、制造自动化恶意流量、上传恶意内容或侵犯他人权利。

7. 第三方服务

Boreki 使用 Apple App Store 与 StoreKit、Cloudflare 网站交付等服务，并可能链接至第三方网站。这些服务受其各自条款约束；对于我们无法控制的第三方服务，我们不承担责任。

8. 我们的权利

Boreki 的软件、设计、品牌及网站内容由 Borealbit Technology Limited 或其许可方拥有，并受适用知识产权法律保护。除上述有限许可外，不会向你转让任何权利。你自愿提供的反馈可由我们用于改进产品，且无需对你承担义务。

9. 可用性、变更与终止

我们可能修复、更新、变更、暂停或停止部分服务，且不保证服务不中断，或兼容所有设备、浏览器、配件及未来操作系统版本。你可以随时停止使用；对于违法、滥用、造成安全风险或严重违反本条款的行为，我们可在合理必要时暂停访问。

10. 免责声明与责任限制

在法律允许的最大范围内，服务按“现状”和“可用状态”提供，不对准确性、特定用途适用性、不侵权或持续运行作出保证。在法律允许的最大范围内，Borealbit Technology Limited 及其人员不对因使用服务产生的间接、附带、特殊、后果性或惩罚性损失，或内容、收入、机会及制作时间损失承担责任。

本条款不排除或限制依法不得排除或限制的权利与责任。

11. 条款变更与联系

我们可能为反映产品、服务商或法律变化而更新本条款，页面顶部日期为最新版本日期。在法律允许的范围内，更新生效后继续使用服务即表示接受更新后的条款。
